It is strongly recommended that each entrant review these rules (the “Official Rules”) in their entirety before entering the Contest.

The “Baker May 2024 Raffle” (the “Contest”) commences on Friday, May 10, 2024, at 9:00 am Eastern Daylight Time and ends on Thursday, May 16, 2024, at 11:59 pm Eastern Daylight Time (the “Contest End Date”) (such period, the “Contest Entry Period”).

SPONSOR: The Contest is solely sponsored by and for the benefit of, and administered by, Baker Real Estate Incorporated (the “Sponsor”). Any questions, comments, or complaints pertaining to the Contest must be directed to the Sponsor.

ELIGIBILITY: The Contest is only open to legal residents of Canada, excluding residents of Quebec, who are eighteen (18) years of age or older at the time of entry. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. By participating in the Contest, each participant unconditionally accepts and agrees to comply with and abide by the terms and conditions stated in these Official Rules which will be final and binding in all respects, agrees to be bound by the decisions of the Sponsor, and warrants that she/he is eligible to participate in the Contest. Directors, officers, employees, agents, and independent contractors of the Sponsor and/or their respective affiliates, immediate family members, and persons living in the same household, are not eligible to participate in the Contest. The Contest is void where prohibited and/or restricted by law and is subject to applicable federal, provincial, and municipal laws and regulations.

HOW TO ENTER: Entrants may enter the Contest by visiting http://may2024Raffle-baker-re.com (the “Contest Website”) during the Contest Entry Period and completing the following two (2) steps:

Upon entry of the required contact details, an email confirmation will be sent to the entrant at the email address provided by the entrant confirming the request for entry into the Contest and providing a unique link to confirm and enter the Contest; and
the entrant must confirm the request by clicking on the unique link provided. All entries are final.

PRIZE: On Tuesday, May 21, 2024, the Sponsor will select one (1) winner from the entire pool of qualified entrants (the “Contest Winner”). The Contest Winner will win a gift card worth CAD $500.00 from Amazon (the “Contest Prize”). The Contest Winner will be subject to all the rules of eligibility, verification, and confirmation specified in these Official Rules.

ODDS OF WINNING: The odds of winning the Contest Prize depends on the total number of eligible entries received during the Contest Entry Period. There is no limit to the number of entries the Sponsor may receive. Only one entry per valid email address will be accepted.

SELECTION OF CONTEST WINNER: On May 21, 2024 (the “Drawing Date”), the Sponsor will select the potential winner of the Contest Prize (the “Potential Winner”) in accordance with these Official Rules. The Potential Winner will be selected by random drawing using a random number generator algorithm from all eligible entries received by the Sponsor during the Contest Entry Period. The Potential Winner will be notified by email shortly after the Drawing Date, using the email address provided with the selected entry, and will be conditionally awarded the Contest Prize subject to verification of eligibility and compliance with the terms and conditions of these Official Rules. The notification will include instructions for how to contact the Sponsor to provide name, address, and other information that may be required to complete validation of eligibility and delivery of the Contest Prize. No liability is assumed by the Sponsor for any Potential Winner notification that is lost, intercepted, or not received by a Potential Winner for any reason.

VERIFICATION OF POTENTIAL WINNER: The Potential Winner is subject to verification by the Sponsor. The Sponsor’s decisions are final and binding in all matters relating to the selection and verification of the Potential Winner. An entrant is not a winner of the Contest Prize unless and until the entrant’s eligibility and compliance with these Official Rules has been verified by the Sponsor, in its sole discretion, and the entrant has been notified that verification is complete. To receive the Contest Prize, the Potential Winner will be required to correctly answer, without assistance of any kind, whether mechanical, electronic, or otherwise, a time-limited mathematical skill-testing question to be administered by, at the Sponsor’s election, telephone or email, by the Sponsor’s designated agent at a mutually agreeable time. If: (a) the Potential Winner does not respond after three (3) attempts have been made to contact them, and in any event within one (1) week following the delivery of the initial Contest Prize winner notification email by the Sponsor; (b) the Contest Prize winner notification email is returned as undeliverable; (c) the Potential Winner fails to provide the necessary information to confirm the Potential Winner’s identity and eligibility to receive the Contest Prize; (d) the Potential Winner declines or cannot accept, receive, or use the Contest Prize for any reason; (e) the Potential Winner is found to be ineligible to enter the Contest or receive the Contest Prize; (f) the Potential Winner fails to correctly answer the mathematical skill-testing question; or (g) the Potential Winner did not, can not, or does not comply with the Official Rules, then the Potential Winner will be disqualified from the Contest and an alternate Potential Winner will be randomly selected by the Sponsor from among the remaining eligible entries received. The Sponsor reserves the right, in its sole discretion, to modify the notification and verification procedures in connection with the selection of an alternate Potential Winner, if any. A Potential Winner will be declared the Contest Winner when all the conditions of these Official Rules are fulfilled to the satisfaction of Sponsor, in its sole discretion. In the event of a dispute as to the identity of the entrant, any online entry will be deemed submitted by the authorized account holder of the email account provided to the Sponsor at the time of entry, provided such account holder still meets the eligibility requirements for the Contest. The authorized account holder will be the natural person to whom the applicable email address has been assigned by the internet access provider, service provider, or other online organization responsible for assigning email addresses for the domain associated with the submitted email address.

CONDITIONS FOR RECEIPT OF THE CONTEST PRIZE: The Contest Prize will be delivered by the Sponsor to the Contest Winner by email. No substitution or transfer of the Contest Prize is permitted except in the Sponsor’s sole discretion. The Sponsor is responsible only for Contest Prize delivery and not Contest Prize utility by the Contest Winner. The Sponsor reserves the right, in its sole discretion, to substitute for the listed Contest Prize, or any portion thereof, one of equal or greater value if the advertised Contest Prize becomes unavailable for any reason. The Sponsor is not responsible if the Contest Winner does not use any portion of the Contest Prize. The Sponsor is not responsible for the Contest Winner’s loss or the theft of the Contest Prize, or any portion thereof. The Sponsor does not provide any type of insurance whatsoever with respect to the Contest Prize. The Sponsor makes no express or implied warranties of any nature whatsoever, including, but not limited to, any warranty of merchantability or fitness for a particular purpose with respect to the Contest Prize. The Sponsor is not responsible for and will have no liability in connection with any failure by any third party to honour all or any portion of the Contest Prize.

TAXES: Any taxes which are payable on, or connected with, the receipt of the Contest Prize are solely the responsibility of the Contest Winner thereof and must be paid by the Contest Winner in accordance with applicable federal, provincial, and/or municipal tax laws.

RELEASE OF LIABILITY: By participating in the Contest, each entrant agrees to the full extent allowed by applicable law to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Contest; and (b) irrevocably releases, acquits, and forever discharges the Sponsor and its affiliates and all of their respective past and present shareholders, directors, officers, employees, agents, independent contractors, attorneys, and representatives, and their successors and assigns (collectively, the “Released Parties”) from any and all existing or potential actions, causes of action, claims, complaints, suits, debts, dues, accounts, damages, or demands for payment, whether arising at law or in equity, by contract, by statute or otherwise, presently known or unknown, which the entrant ever had or now or in the future may have in any way relating to, arising out of, or connected with the entrant’s entry into and participation in the Contest, and/or acceptance, possession, defect in, delivery of, inability to use, use, or misuse of the Contest Prize or any portion thereof. The Released Parties are not responsible if the Contest Prize, or any portion thereof, is delayed, cancelled for any reason, or unusable in whole or in part, in which event that portion of the Contest Prize is forfeited in its entirety and no substitution will be provided except at the Sponsor’s sole discretion. The Contest Winner acknowledges that the Contest Prize is awarded “as-is” and the Sponsor expressly disclaims any warranties, express or implied, including, but not limited to, warranties of merchantability and fitness for a particular purpose, relating to the Contest Prize in any way.

PUBLICITY RELEASE: Except where prohibited or restricted by law, the Contest Winner’s acceptance of the Contest Prize constitutes the Contest Winner’s agreement, permission, and consent for the Sponsor and any of its designees to use and/or publish the Contest Winner’s full name, city and province or territory of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, and/or statements made by the Contest Winner regarding the Contest or otherwise, worldwide and in perpetuity for all purposes, including, but not limited to, advertising, publicity, trade and/or promotion on behalf of the Sponsor, in any and all forms of media now known or hereafter devised, including, but not limited to, print, television, radio, electronic, cable, digital, or social media, without further limitation, restriction, compensation, notice, review, or approval.

PRIVACY: To participate in the Contest, entrants will be required to supply certain information about themselves on the Contest Website entry page. The Sponsor has specified on the Contest Website which information is mandatory to participate in the Contest. This information will be used by the Sponsor solely for the purposes of administering the Contest, and may be shared with the Sponsor’s affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, legal advisors, and service providers as necessary for Contest administration purposes. The personal information will be collected, processed, and used in accordance with the privacy policy found at https://baker-re.com/privacy-policy/.

OPTING IN TO RECEIVING NEWS AND PROMOTIONAL EMAILS: Entrants will also be offered the opportunity to opt in to receiving news and promotional emails from time to time from the Sponsor and/or its project partners. Opting in is not required to participate in the Contest. Entrants may unsubscribe at any time to stop receiving communications from the Sponsor. The Sponsor will use the information submitted by entrants in a manner consistent with the Sponsor’s Terms of Use. By opting in, entrants agree to the Sponsors Terms of Use and Privacy Policy and consent to the collection, storage, and use of this information in Canada, subject to Canadian laws and regulations. GENERAL CONDITIONS: None of the Released Parties will have any obligation or responsibility, including any responsibility to award the Contest Prize to entrants, with regard to: (a) entries that contain inaccurate information and/or do not comply with and/or violate these Official Rules; (b) entries, Contest Prize claims and/or notifications that are lost, late, incomplete, illegible, unintelligible, damaged, and/or otherwise not received by the intended recipient, in whole or in part, due to computer, human, and/or technical error of any kind; (c) entrants who have committed fraud and/or deception in entering and/or participating in the Contest and/or claiming the Contest Prize; (d) telephone, electronic, hardware, software, network, internet, and/or computer malfunctions, failures, and/or difficulties; (e) any inability of a Contest Winner to accept the Contest Prize for any reason; (f) if the Contest Prize cannot be awarded due to delays and/or interruptions due to acts of god, natural disasters, terrorism, pandemics, weather, and/or any other similar event beyond the Sponsor’s reasonable control; or (g) any damages or losses of any kind caused by or resulting from awarding, acceptance, possession, use, misuse, loss, or misdirection of the Contest Prize or resulting from participating in the Contest. Sponsor reserves the right, in its sole discretion, to disqualify any entrant it finds to be: (i) tampering with the entry process or the operation of the Contest, the Contest Website, or with any website promoting the Contest; (ii) acting in violation of these Official Rules; or (iii) entering or attempting to enter the Contest multiple times in violation of these Official Rules or the use of any robotic or automated devices to submit entries. If the Sponsor determines, in its sole discretion, that technical difficulties, malfunction, error, disruption, or other unforeseen events compromise the administration, security, fairness, integrity, proper conduct, or viability of the Contest, the Sponsor reserves the right to void the entries at issue, terminate the Contest, modify the Contest, and/or award the Contest Prize from all eligible entries received as of the termination date. The Sponsor reserves the right to suspend, modify, or cancel the Contest before the scheduled Contest End Date. In the event the Contest is canceled, all entries into the Contest will be deemed null and void, no Contest Winner will be selected, and no Contest Prize will be awarded or delivered.

GOVERNING LAW; SEVERABILITY; WAIVER: The Contest and these Official Rules are subject to and governed by the laws of the Province of Ontario and the federal laws applicable therein. If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular person or circumstances, is invalid or unenforceable to any extent, then the remainder of these Official Rules, and the application of all of these Official Rules to other persons or circumstances, will not be affected by that determination, and will remain enforceable to the fullest extent permitted by law. The failure of the Sponsor to enforce at any time any provision of these Official Rules shall not be considered a waiver of such provision or any other provision and shall not deprive the Sponsor of the right thereafter to enforce such provision or any other provision.

COPYRIGHT: All Contest materials are the property of the Sponsor and may not be copied, reproduced, or used for any purpose without the Sponsor’s express prior written consent.

NOTICE: The Sponsor reserves the right to prosecute and seek damages against any individual who attempts to deliberately undermine the proper operation of the Contest in violation of these Official Rules.
